Abstract

[extract] Bazilian mediation was formally regulated in 2016, when two important laws came into force, the “Mediation Law” and the “Brazilian Civil Procedure Code”. Both laws encourage the use of mediation. The Brazilian Civil Procedure Code establishes that mediation “shall be encouraged by judges, lawyers, public defenders and members of the Public Prosecution Service, even in the course of judicial proceedings”.
